Terms and Conditions

Definitions - What we mean when we say:

  • we, us and our – this means ROAR Dog Training and its directors, employees and/or agents;
  • you and your – this means you as the participant in the dog training services provided by ROAR Dog Training;
  • Training – this means the dog training services that are provided by ROAR Dog Training as set out in ‘Training Packages’ on our website;
  • Enrolment – this means your commitment to undertake the selected training, subject to your payment of applicable fees and compliance with the terms and conditions set out here within.


How these terms and conditions apply

These terms and conditions apply to your participation in the dog training services and/or packages provided by ROAR Dog Training (the “Training”).


These terms and conditions and your participation in the Training are governed by the legislation and laws in force in Queensland.


Your obligations in undertaking the Training

 Your commitment to ROAR Dog Training requires that you will:

  • always be responsible for your own and your dog/s safety;
  • be courteous and considerate of other Training participants and the communities in which Training is undertaken;
  • wear appropriate clothing including closed in shoes;
  • ensure training tools (including but not limited to collars, leads, harnesses etc) are fit for purpose and checked prior to each Training session for damage, breaks, tears, etc. Where such is identified, the defective training tool/s shall be discarded and not used during the Training;
  • comply with all our rules, conditions and reasonable directions when undertaking the Training;
  • inform us in writing (via info@roardogtraining.com) at least twenty-four (24) hours prior to the Training if you are no longer able to participate in the Training, otherwise, you remain liable for the full cost of your enrolment;
  • be flexible in the event that we cancel a class due to inclement weather or other circumstances and acknowledge that any classes cancelled by us will be added onto the end of the original group class schedule;
  • be committed to attending the consecutive nature of the group classes (once per week for 6 consecutive weeks on the selected day and time) and understand that any missed classes are forfeited, except at our sole discretion, for the full cost of the missed class, unless we cancel the class;
  • where classes missed by you are deemed reasonable, at our sole discretion, you understand and accept that any allowed make-up class may not address the particular class learnings that were missed and are subject to availability, in consideration of the maximum number of dogs in classes;
  • consent for us to take and use footage (photographs and/or video) of you and your dog during the Training within your home, local area and/or training locations for marketing and/or training purposes; and
  • advise us in writing prior to the Training if you do not wish to have footage or photography taken of your dog for any purpose associated with the Training.


Our obligations in providing the Training

In, Out & About (IOA) your home consults and group training classes are provided on a lesson-by-lesson and/or package basis. The goal is to teach you (and/or your household) how to train and work with your dog. These lessons will take place at your home and/or in the local area. 


We will:

  • carry out the Training as advertised within a reasonable time using an acceptable level of skill and/or technical knowledge; and
  • take reasonable steps to avoid loss or damage when providing the Training.

 

We will make every reasonable effort to help you achieve training and/or behaviour modification goals but make no guarantee of your dog’s performance or behaviour in relation to the engagement of dog behaviour consultation and/or Training. For best results, you will follow training advice and maintain the dog’s behaviours with ongoing training and reinforcement.


Privacy obligations

  • we will ensure that we comply with applicable privacy legislation when we collect and store your personal information; and
  • we will not share your personal information with any third parties.


Fees and Cancellations

Our fees may be subject to change. (Training Packages)


Training may be subject to additional travel costs for locations outside of standard service areas. A quote will be provided at the time of your booking.

Training packages are valid for 6 months from the date of purchase. We are not obliged to refund you the unused portion of the Training package if you do not complete all your sessions within the 6-month period except to the extent permitted by the law, or at our sole discretion.


Except to the extent required by law, we are not obliged to refund you or roll over training classes or consults if you:

  • fail to respond to confirmation communications (for IOA) at least twenty-four (24) hours prior to the scheduled Training;
  • change your mind and cancel the Training;
  • fail to inform us in writing (via info@roardogtraining.com) at least twenty-four (24) hours prior if you are no longer able to participate in the Training;
  • fail to attend at the time of the scheduled Training;
  • commence the Training and are unable to complete it;
  • insist on having/doing the Training provided in a particular way against our advice;
  • fail to clearly explain your needs to us before commencing the Training;
  • breach our terms and conditions.

 

We may be required to alter or cancel the Training without notice or on short notice if:

  • there are weather events making it unsafe to train or due to unforeseen circumstances outside of our control;
  • your dog is a risk to us, any other person or animal, or if your dog interferes with the training of other dogs.

 

We will not be liable for any losses arising from cancelled, delayed and/or rescheduled Training except to the extent permitted by law.


Breach of terms and conditions

If you become aware that you have inadvertently breached any of these terms and conditions, you must immediately:

  • advise us of that breach;
  • stop participating in the Training until we advise you can resume.

A breach of these terms and conditions may result in one or more of the following actions:

  • a direction to change your conduct;
  • suspension of your participation in the Training;
  • termination of your participation in the Training;
  • you remain liable for the full cost of your enrolment.

 

Responsibility for actions and your liability to us

You will be responsible for (and you indemnify us against) any loss or damage to any person, property or animal resulting from any:

  • loss, damage or injury arising as a result of your dog’s behaviour;
  • wilful, negligent or unlawful act or omission by you in relation to, or in the course of, participating in the Training;
  • breach by you of these terms and conditions;
  • other claim, loss, demand, cause of action, cost or liability (including reasonable legal fees and expenses) which may be asserted against or incurred by us as a result of your participation in the Training.

 

However, your liability to us will be reduced to the extent that any wilful, negligent or unlawful act or omission by us has contributed to that loss or damage.


Limited liability

Liability for any negligent failure by us to carry out our duties under these terms shall be limited to such liability as is covered by our Public & Products Liability Insurance Policy terms and in no event shall our liability exceed the fees paid to us. A copy of our Certificate of Currency can be provided upon request. 


We will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages (including for loss of profits, goodwill, information, data or other intangible losses) resulting from your participation (or the inability to participate) in the Training.


No Guarantees by us

We will make every reasonable effort to help you achieve training and/or behaviour modification goals but make no guarantee of your dog’s performance or behaviour in relation to the engagement of dog behaviour consultation and/or Training. For best results, you will follow training advice and maintain the dog’s behaviours with ongoing training, consistency and reinforcement. We do not guarantee that the results of the Training will last for any length of time.


We do not promise or guarantee that your dog will:

  • never bite;
  • not be dangerous in the future;
  • not exhibit or develop other behavioural problems.

 

No warranties by us

Except as specified in these terms and conditions, we give no implied or express warranties in relation to your participation in the Training. All statutory warranties are, to the fullest extent permitted by law, expressly excluded.


Our rights

  We can:

  • limit your ability to participate in the Training;
  • terminate your Training at any time in accordance with these terms and conditions;
  • schedule, cancel, delay, reschedule the times, periods and locations in which the Training takes place;
  • vary the terms and conditions of the Training  (the terms and conditions applicable when you next participate in the Training may be different from these terms and conditions). Current terms and conditions are available on our website.
